ABIRU JCA (Delivering the Lead Judgment): This appeal is against the judgment of the High Court of Kaduna State in suit No. KDH/KAD/155/2008, delivered by Honourable Justice Isa Aliyu on 24 September 2013. The appellant was the plaintiff in the lower court and his claims were for:

The sum of ₦300,000.00 (three hundred thousand naira), being the outstanding credit owed by the defendant in favour of the plaintiff from the sale of a complete V6 125 Mercedes Engine on 1 March 2008.

Cost of this action in the sum of ₦100,000.00 (one hundred thousand naira), which represents the total fees the plaintiff paid to his solicitors for the prosecution of this action. Interest on the entire judgment sum at the rate of 10% per annum from date of judgment until final liquidation of the entire judgment sum.
