OLABODE ABIMBOLA ADEGBEHINGBE, J.C.A. (Delivering the Lead Judgment): Before the trial Court, the Appellant herein was the Plaintiff. The Respondent herein was the Defendant. The case of the Appellant before the trial Court is that he is the grandson of one Zira.
Zira died and left behind properties in his estate. Sometime after Zira's demise, properties in his estate were distributed among his children and descendants.
The Respondent received a portion of the distributed estate on account of the fact that it was believed, understood and accepted at the time that Ngu, the Respondent's father was Zira's son. So, the Respondent was given his father's share of the estate because his father had died. Later, the Appellant claimed to have realised that the Respondent's father was not the biological son of Zira.
