OWOADE JCA (Delivering the Leading Judgment): This is an appeal against the decisions of the High Court of Cross River State contained in the judgment of Honourable Justice W.S.N. Onnoghen in suit No. C/572/ 1996 of 24thFebruary, 1997and also the ruling of Honourable Justice Evaritus Uke of 3rd December, 2003, whereby he made the garnishee order nisi granted on 11th November, 2003, an order absolute .

On 20th November, 1996, the respondents as plaintiffs before the lower court endorsed a writ of summons against the defendant/appellant whereby they claimed as follows:

  1. N700,000.00 (seven hundred thousand naira) being cost of two volumes of House Boat Drawing and Designs produced by the plaintiffs for the defendant at her request.

  2. N1,000,000.00 (one million naira) for assault and character assassination of the 1st plaintiff by the defendant.

  3. N50,000.00 for personal injuries occasioned 1st plaintiff by the defendant.
