JUDGMENT
INTRODUCTION
On 18th April, 2018, the Plaintiff issued a Writ of Summons against the Defendants and per its Amended Statement of Claim filed on 28th October, 2022 claimed jointly and severally against the Defendants the following: -
a) The sum of GHS493,341.78 being the sum owed by Defendants to Plaintiff as at 18th February, 2018.
b) Interest on the sum of GHS493,341.78 at a compound interest of 4.7% per month from 19th day of February, 2018 till date of final payment.
c) Cost inclusive of legal fees.
The 1st and 2nd Defendants denied this claim and averred that the Plaintiff had held on to invoices and waybills for food items purchased worth GHS389,380.00 and had prevented them from submitting same for payment to be effected by 3rd Defendant. The 3rd Defendant also denied the claims of the Plaintiff against it and averred that it was never a party to any loan transaction between the Plaintiff and 1st and 2nd Defendants neither did it guarantee any loan to be liable for any p…
