PETER OLABISI IGE, J.C.A. (Delivering the Leading Judgment): The Appellant was one of the two persons charged and arraigned before the High Court of Justice Plateau State on four counts as per the Amended charge filed on 10th November, 2003 which read:

1. That you Yohanna Dalyop and Ahmed Ladan Gobir on or about the 22nd day of September, 2000 at Jos with (sic) the jurisdiction of this Court agreed to do or caused to be done an illegal act wit: forged certain documents and that the forgery was done in pursuance of the agreement and that you thereby committed an offence contrary to Section 97 of the penal Code.

2. That you Yohanna Datyop on or about the 22nd day of September, 2000 forge certain documents to wit: a letter head of Cotton and Agricultural Processors Ltd. to show that an offer of fifty million naira (N50, 000,000.00) was made and another letter addressed to your company acknowledging the receipt of ten million naira N10, 000,000.000) with the intention cause Plateau Invest…
