CHUKWUMA-ENEH, JCA (Delivering the Lead Judgment): This appeal is against the ruling of 14/7/93 given by the Damaturu High Court of Yobe State, sitting in its appellate jurisdiction, wherefore the substantive Appeal No. BOM/3A/90 before it was struck out. The application upon which the said ruling was predicated as shown in the record was filed by the respondent (as also respondent in the Court below) and it constituted a preliminary objection praying the said High Court (to be referred tohereinafter as “the court below”) to strike out the said appeal on the basis that the notice of appeal is incompetent. In this court, the appellant has taken umbrage that the two grounds of appeal contained in the Notice of Appeal to wit, - an omnibus ground, that is, ground 1 (one) and ground 2 (two) that is - an error in law without the particulars of error - are incompetent and in consequence of that, the said Notice of Appeal on which the appeal was hoisted is clearly defective.
