(Delivering the Lead Ruling): My lords, sadly, while this application is a fallout of the Dana Air crash of 12/6/2012 leading to the loss of several lives, the question whether Dana Airlines Limited is liable and to what degree are clearly not part of this present Application before this Court, as indeed these are the subject matter of Suit Nos: FHC/L/CS/307/2014, FHC/L/CS/308/2014,FHC/L/CS/309/2014,
FHC/L/CS/407/2014, FHC/L/CS/408/2014 and FHC/L/CS/591/2014, all pending before the Court below.
In this Application filed by way of a Motion on Notice on 22/11/2016 and brought pursuant to Section 242 (1) of the Constitution of Federal Republic of Nigeria 1999 (as amended), Section 24(2) (a) of the Court of Appeal Act 2004 and Order 7(1) and (10) of the Court of Appeal Rules 2011, the Applicant is praying this Court for the following reliefs:
