UZO NDUKWE-ANYANWU, J.C.A.(Delivering the Leading Judgment): This is an appeal against the judgment of the Governorship and Legislative Houses Election Tribunal, Plateau State holden at Jos. The Petition was presented by the 1st and 2nd Respondents against the motion and return of the Appellant Emmanuel Danboyi. In the Tribunal below the 1st and 2nd Respondents were aggrieved that the name of the 1st Respondent and the symbol of the 2nd Respondent were omitted in the ballot paper for the election into the Riyom Constituency for the Plateau State House of Assembly on 14th April, 2007. At the trial the Tribunal nullified the election of the Appellant in its judgment delivered on 23rd November, 2007 and ordered for a fresh election within 90 days.
