JUDGMENT 

i. Introduction: 

[1] This is an interesting case. The Plaintiff is seeking an order against the Defendant to plot  the land judicially pronounced to belong to his family and also asking for General Damages for  the loss suffered due to the Defendant’s delay in plotting the land.

[2] On the 16th day of August, 2016 the Plaintiff issued a Writ of Summons claiming against  the Defendant, the judicial reliefs mentioned here below:  

1. A declaration that the Defendant immediately plots the land adjudged to belong to the  Plaintiff and his family in the suit entitled JUSTICE GILBERT MENSAH QUAYE  SUBSTITUTED BY DANIEL MENSAH QUAYE V. KOIWAH INVEST  COMPANY LIMITED and ORS: Suit No. TRLD13/2009 in their name. 

2. General damages for the loss suffered by the Plaintiff as a result of the delay in plotting  the said land in their name.  

[3] Appearance was entered on August 30, 2016 after service of the Writ and Statement of  Claim. A Statement of Defence was filed on November 30, 2016…
