JUDGMENT
COUSSEY P. These appeals in two actions which were consolidated for hearing arise from the dismissal of the plaintiff's claim in the first action, for damages for wrongful arrest and false imprisonment, and in the second action, for damages for false imprisonment and malicious prosecution.
In the first action, the learned trial judge held that the defendants acted in the honest belief that they were discharging their official duties; that without invoking section 136 of the Local Government Ordinance, c. 64 of 1951, which so far as it is material, provides that no matter or thing done by a member or officer or employee of a council bona fide for the purpose of the Local Government Ordinance shall subject any member or officer or employee thereof to any action, etc., there was satisfactory evidence that the defendants could not be deemed to have unlawfully caused the arrest and detention of the plaintiff.
