ADAH, J.S.C. (Delivering the Leading Judgment): This appeal is against the decision of the Court of Appeal, Makurdi Judicial Division, in Appeal No. CA/MK/15CA/2019, delivered on the 25th day of March, 2020. The lower court, in its decision, affirmed the judgment of the High Court of Justice, Nasarawa State (trial court), delivered on the 3rd day of May, 2018, in Charge No: NSD/LF/37C/2012. In the judgment of the trial court, the appellant, alongside 2 other accused persons, was convicted and sentenced to 21 (twenty-one) years imprisonment.

The appellant (as the 2nd accused person), on the 11th day of July, 2012, was arraigned before the trial court with his two co-convicts on a seven-count charge bothering the offenses of conspiracy to commit armed robbery and armed robbery under sections 6(b) and 1 & (2)(a) of the Robbery and Firearms (Special Provisions) Act, Cap. R11 LFN, 2004.
