JUDGMENT

WELBOURNE (MRS), J.A.: This is an appeal against the Ruling of the High Court dated 5th June, 2012. For ease of reference the parties will be known as Petitioner and Respondent in this appeal.

The background facts:

On 19th November 1991, the Petitioner, David Ayiku Awotwi filed a divorce petition against Maria Francesca Awotwi the Respondent/Respondent seeking an order to annul the marriage between the parties and for the grant of custody to the children in the marriage. The Respondent opposed the granting of the Petition but asked for financial and property settlement upon dissolution.

The matter travelled over a period of fourteen (14) years under different judges until 20th February, 2006 when the court presided over by H/L Justice Lartey Young dissolved the marriage between the parties and granted the divorce order.
