(Delivering the Leading Judgment): The appeal is against the judgment of the National and State Houses of Assembly Election Petition Tribunal for Kogi State (herein after referred to as the Court Below) Coram: Hon. Justice O.A. Chijioke (Chairman), Hon. Justice Eno I. Ebri and Hon. Justice M.A. Haruna (Members) in Petition No.: EPT/KG/NASS/HR/01/2019 delivered on the 29th day of August, 2019 wherein Appellants' petition was struck out.
The Appellants, at the lower Court, are challenging the return of the 4th Respondent as the winner of the Election conducted in Kogi State by the 1st Respondent to the Ankpa, Omala, Olamaboro Federal Constituency of the House of Representatives, on 23rd February, 2019.
