In this case the plaintiffs, a sub-chief and the Paramount Chief or Omanhene of Denkyera State, instituted 'an action in the Land Court of the Central Judicial Division at Cape Coast against the Paramount Chief or Omanhene of Abura State averring what they described to be the ancient boundary between the plaintiffs' stool and the defendant's stool, that the defendant's subjects, agents and licensees had trespassed over such boundary; and claiming a declaration that the boundary was as alleged by the plaintiffs and damages for trespass on the plaintiffs' land called Ajentonghu land and an injunction to restrain further trespass by the defendant over the said boundary and on the plaintiffs' land.
By the statement of defence delivered, the defendant described a different boundary as the correct boundary between the contending stools and denied the trespass alleged and the plaintiffs' right to the injunction claimed.
