TSAMMANI JCA (Delivering the Lead Judgment): This appeal is against the judgment of the Oyo State High Court holden at Ibadan in Suit No. I/694/95, delivered by T. O. Adeniran, J on 30 July 1996. The brief facts of the case arise from a contract between  the appellant and the respondent, wherein the appellant undertook to deliver two return air tickets to the respondent’s wife in Portsmouth, Common Wealth Dominica, in the West Indies, on 17 November 1992. That, the tickets were meant for the return journey to Nigeria of the respondent’s two children to wit: Mr. Olalekan A. Oyeyemi (10 years old) and Miss Olusola A. Oyeyemi (12 years old), who had gone to Dominica, West Indies to stay with their mother. That, the value of the two return tickets was four thousand, nine hundred and fifty-two U.S. Dollars ($4,952.00) only.
