(Delivering the Lead Judgment): The instant appeal is a fall-out of the judgment of the Court of Appeal, Abuja Judicial Division, delivered on November 7, 2025, in Appeal No. CA/ABJ/CV/1165/2025. By the judgment in question, the Court below coram H.A Barka, O.A Adeniyi, and L.B Lawal-Akapo, JJCA, allowed the 1st Respondent’s appeal, set aside the judgment of the trial High Court of Niger State, and struck out the originating summons (No. NSHC/MN/144/2025). 

BACKGROUND FACTS 

On May 5, 2025, the Appellant filed the suit vide an originating summons, thereby seeking the determination of the following questions:

  1. Whether the Plaintiff is entitled to have his name submitted to the 3rd Defendant as the Candidate of the 2nd Defendant in the forth coming local Government Council Election 2025.
