CHIDIEBERE NWAOMA UWA, J.S.C. (Delivering the Leading judgment): The appeal is against the judgment of the Court of Appeal, Ibadan Division (hereinafter referred to as the court below) delivered on 21st March, 2016, wherein the court dismissed the appeal for lacking merit.
The essential facts leading up to this appeal are that the appellant “as plaintiff" commenced the action by a general form of complaint filed on 9/4/13 against the respondents before the National Industrial Court (hereinafter referred to as the trial court) seeking the following reliefs:
“(i) An Order quashing the findings and recommendations of the four committees instituted by the defendants to try the claimant, the same being ultra vires and contrary to the provisions of section 6 of the 1999 Constitution (as amended) and S. 8:1.5 of the Staff Information Handbook of the University of Ibadan.
