OGBUAGU JCA (Delivering the Lead Judgment): This is an appeal against the judgment/decision of the Gombe State High Court sitting at Gombe in its appellate jurisdiction [coram Hon. Justice Haman, H.Y. (Chief Judge presiding) and Hon. JusticeYakubu, A.M.] delivered on 3rd November, 2003, dismissing the appeal of the appellant from the Civil Area Court, A Gombe and affirming the decision of the Upper Area Court, Gombe (hereinafter referred to as “the U.A.C.”) that also dismissed the appeal of the appellant from the said trial Civil Area Court. Dissatisfied with the said decision, the appellant has appealed to this court on three (3) grounds of appeal which, without their particulars, read as follows: “(i) The High Court of Justice sitting on appeal in Gombe grossly erred in law, when it confirmed the judgment of the two lower courts, despite the fact that such judgments were not based on evidence or facts adduced before the courts.
