MOHAMMED LAWAL GARBA, J.C.A. (Delivering the Leading Judgment): By a writ of summons taken out of the Registry of the High Court of Kaduna State on the 19/9/2000, (which is at page 2 of the record of appeal) the Appellants along with four (4) others made claims against the Respondents set out in the endorsement as follows:-
"1 A declaration of title to all that piece of land lying, situate and known as No 1 Ibrahim Taiwo Road, Tudun Wada, Kaduna;
2. A declaration that the purported transfer or sale (if any) of the property lying, situate and known as No.1 Ibrahim Taiwo Road, Tudun Wada, Kaduna by the 2nd and 3rd defendants to the 1st defendant without the consent of the plaintiffs is unlawful, illegal, null and void and of no legal effect.
