JUDGMENT
INTRODUCTION
This is a simple contractual agreement between the parties for sums advanced to Defendants by Plaintiff and for which the Defendants are yet to completely liquidate the amount due Plaintiff. The Plaintiff’s claim is for the sum of GHS772,461.54 out of which the Defendants admitted in their Defence filed on 19th November, 2019 to owing only GHS484,000.00. Till date the Defendants have failed to pay to the Plaintiff the outstanding sum and this matter unfortunately had to go through a full trial.
The Plaintiff is in the business of financial investments and the 2nd Defendant is an Executive Director and Shareholder of 1st Defendant Company whose business is construction. The terms of the facility which was used for the construction business is contained in the term sheet executed by the Plaintiff and the Defendants.
