RAPHAEL CHIKWE AGBO, J.C.A. (Delivering the Leading Judgment): In the preparation of the judgment in this case, I was shocked to discover that the appellant did not include in the record of appeal the proof of evidence. The shock was even greater when I discovered that the exhibits including the documentary exhibits that included the statements of the accused which the lower Court found was confessional were not transmitted to this Court. The record of appeal is grossly incomplete and cannot form the basis for the determination of this appeal. This appeal is struck out.
