OMAGE JCA (Delivering the Lead Judgment): This is an appeal from the interlocutory order made by the Honourable Justice Charles Ikpa of the Akwa Ibom State High Court sitting at Uyo. The order in the ruling was made on 14th June, 2005.

The issue determined by the trialJudge arose from the dispute between members ofthe Nigerian Union ofLocal Government Employees (NULGE), in their conference. The relevant issue is on the procedure adopted at the conference of the delegates and officers of the said union. The respondent was not allowed to participate in the election at the conference as a result of alleged constitutional procedure at the meeting. Violence was reported to have erupted at the conference. As a result of which the respondent went to the High Court, Akwa Ibom. The respondent in this application being dissatisfied with the proceedings at the conference, he filed in the High Court, Akwa Ibom State for the following reliefs:
