This is an interlocutory appeal against the Ruling of the High Court, Criminal Division for having on 49th March 2021 rejected the Appellant's application to strike out Counts 2, and off the charge sheet.

The facts culminating in this appeal are as follows:

The victim then Senior High School student, telephoned her mother to inform her that she had seen her nude pictures on social media. Her mother, the complainant, verified this information on Facebook which led her to website where indeed she found pictures of her daughter in varlous anal and oral sex activities including pictures that showed the genitals of the victim. complaint was lodged at the Police Station and subsequent investigations indicated that the Appellant met the victim at party when she was fourteen years old..Some months later, the Appellant invited the victim to watch film at the West Hills Mall, Accra, on 14'" February 2015 after which he proposed love to her.
