JUDGMENT  

Plaintiff instituted this action against Defendant on the 9th February 2009. With  leave of the Court Plaintiff filed an amended Writ of Summons and Statement  of Claim for the following reliefs: 

a) A Declaration of title to all that land in dispute which was originally part  of Plaintiff’s land subsequently designated as an integral part of the  Motorway Extension, and therefore an Exclusion Zone not belonging to  the Defendant. 

b) A declaration that Defendant has no right to encumber any part of the  frontage of Plaintiff’s land as it forms part of the designated dual  carriage way for public use. 

c) An order of perpetual injunction restraining the Defendant, his agents,  privies, assigns, servants, workers and persons claiming through by or  under the Defendant from interfering with the land in anyway.

d) General damages against the Defendant for trespass. 

e) Any further orders as this court will deem fit.
