UGOCHUKWU ANTHONY OGAKWU, J.C.A. (Delivering the Lead Judgment): The provenance of this matter is in an agreement which the Respondent had with a client for the construction of some buildings in Bwari, Federal Capital Territory, Abuja. Based on the allegation that the Respondent did not use all the monies advanced to him for the building construction, a report was lodged with the Bwari Division of the Nigeria Police Force. Contemporaneously, similar allegations were made to the office of the AIG, Zone 7, Nigeria Police Force, and to the 1st Respondent, and these law enforcement agencies were simultaneously carrying on their investigations, inviting the Respondent for questioning.

Regarding the treatment meted out to him by the Bwari Division of the Nigeria Police Force, the Respondent was compelled to institute an action for the enforcement of his fundamental rights before the High Court of the Federal Capital Territory, Abuja in SUIT NO.
