OBADINA, J.C.A.: (Delivering the Leading Judgment): This is an appeal by the appellant (Justin Effiong) against the judgment of the Local Government Council Election Tribunal, Cross-River State, sitting at Calabar in petition No. LGET/CPS/P/1/98. The appellant was the 5th respondent in the petition.
On the 5th December, 1998, Election were conducted into the Local Government Councils throughout Nigeria including that of Odukpani Local Government Area of Cross Rivers State. The appellant was a Chairmanship candidate to Odukpani Local Government Council under the platform of All Peoples Party (APP).
At the said election, the contestants were as follows;-
1. The appellant (Justin Effiong) for the All Peoples Party (APP).
2. Pastor Ebong Inya Inya for the AD.
3. Mr. Archibong Ekpiken UDP and
4. The 1st respondent (Elder Ebong Ikpeme) for PDP.
The appellant stated that the 4th respondent (Ibok Okokon Ekpenyong) did not contest the election.
