SAIDU TANKO HUSAINI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgement of the High Court of Bayelsa State sitting in Yenagoa delivered on the 22nd of October, 2009 in Suit No. YHC/166/2006.

The Respondents as plaintiffs claimed the following Reliefs:-

1. A DECLARATION that by virtue of the fact of the defendants expulsion from the Gospel Deliverance Mission under the leadership of the Executive Committee of the Mission, they are estopped from further parading themselves as functionaries and or members of the said church and or making further use of or otherwise laying claims to the Church name, facilities or hall at No. 28 Gwegwe Street, Ovom-Yenagoa or elsewhere.

2. A DECLARATION that legitimate ownership, control and or administration of the Gospel Deliverance Mission and all properties, facilities and or members thereof is vested exclusively in the Executive Committee of the said Mission as represented by the plaintiffs herein.
