I. G. MBABA, JCA (DELIVERING THE LEADING JUDGMENT): Appellant, a medical Doctor, had instituted an action on 25/4/13 against the Respondents for the enforcement of his fundamental rights in the Federal High Court, Owerri, in FHC/CS/OW/88/2013, seeking the following reliefs:

(a) A declaration that the Applicant is (sic) entitled to be represented by Counsel of his own choice during the proceeding of the Medical and Dental Practitioners Investigating Panel on allegation of falsification of Autopsy Report.

(b) A declaration that the Indictment of the Applicant by the Medical and Dental Practitioners Investing (sic) Panel, following its proceedings held on 25th to 31st, August 2012 at Benchmark Hotel, Odu-Obi Crescent, Ikenegbu Layout, Owerri, Imo State is a denial of the Applicants fundamental Right.

(c) A declaration that the Applicant can only be tried and or indicted for an allegation of falsification of Autopsy Report in the terms set out in the Petition of Mr. Emmanuel Ifeanyichukwu Du…
