BOLOUKUROMO MOSES UGO, J.C.A.(Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Edo State of 29/06/2009 in Suit No B/17/2001 dismissing the claims of the appellant for:

1. A declaration that the purported termination of his appointment from the service of the Edo State Judiciary vide letter reference No C. 5/vol. 11/526 dated 1st November 2000 is wrongful, null and void and of no effect whatsoever.

2. A declaration that as a public officer on permanent pensionable appointment, the Plaintiff is entitled to remain in the Defendants employment until lawfully retired.

3. An order directing the defendant to reinstate the plaintiff forthwith and pay to him all his arrears of salaries and other entitlements or remunerations from 1st October, 1996 till date of judgment and thereafter till date of his lawful retirement.
