JAMILU YAMMAMA TUKUR, J.S.C. (Delivering the Lead Judgment): This is an appeal against the judgment of the Court of Appeal, Ibadan Judicial Division in Appeal No. CA/IB/107C/2018 delivered on 24th March 2022 against the Appellant.
The facts of the matter which culminated in this appeal arose from the arrest of the Appellant on suspicion of being the person who robbed one Tosin Obalakun of his motorcycle and other belongings while armed with a knife.
The Appellant, after investigation, was charged and tried before Honourable Justice P.F. Oduniyi of the High Court of Justice, Ogun State, for the offence of armed robbery contrary to S.1(2)(a)(b) of the Robbery and Firearms (Special Provisions) Act Cap. R.11, Vol 14, Laws of the Federal Republic of Nigeria, 2004.
Upon conclusion of trial, the trial Judge found the Appellant guilty as charged and consequently sentenced the Appellant to death by hanging.
