TOM SHAIBU YAKUBU, J.C.A. (Delivering the Leading Judgment): The Appellant was the Bursar while the 2nd Respondent alongside with whom he was charged in the case now on appeal was the Provost - Interim at the Nwafor Orizu College of Education, Nsugbe in Anambra State. They were arraigned by the 1st respondent, for prosecution at the Federal High Court, sitting at Awka, Anambra State, for the offences of conspiracy to obtain money by false pretence and obtaining money by false pretence, contrary to Sections 8(a) and 1(1) of the Advance Fee Fraud and Other Related Offences Act, 2006. The information filed by the 1st respondent against the defendants contains eight (8) counts, detailing the various amounts of money allegedly withdrawn by the appellant from the Nwafor Orizu College of Education, Nsugbe, Anambra State, to settle the hotel bills of the 2nd Respondent, as the Provost Interim of the aforesaid Nwafor Orizu College of Education, Nsugbe, Anambra State between November, 2008 and …
