ITA GEORGE MBABA, J.C.A.(Delivering the Leading Judgment): This appeal arose from the judgment of Abia State High Court in Suit No. HU/168/2011, delivered on 25/7/2012 by Hon. Justice A.U. Kalu (as he then was), declining the recognition of the 4th Appellant as the Traditional Ruler of Ozaa Ukwu Autonomous Community in Ukwa West Local Government Area of Abia State. Appellants, as Claimants at the Lower Court had, on 24/11/11, filed the Suit, seeking:

(1) A declaration that the 4th Defendant is not the traditional ruler of Ozaa Ukwu Autonomous Community Ukwa West L.G.A. Abia State.

(2) An Order nullifying the recognition of the 4th Defendant as the traditional ruler of Ozaa Ukwu Autonomous Community aforesaid.

(3) An Order directing and commanding the Defendants to recognise the 4th Claimant as the traditional ruler of Ozaa Ukwu Autonomous Community aforesaid.
