J U D G M E N T 

Introduction 

This is a matter that was initiated by the plaintiff on 15th February 2010. Evidence  was led before Okwabi J. and at the close of the case, the defendant applied to have  an independent forensic examination of the plaintiff’s disputed signatures after having  seriously disputed the evidence of the court appointed forensic examiner. On 3rd June  2014, the court differently constituted ordered an independent forensic examination  to be conducted on the plaintiff’s disputed signatures. On 30th October 2014, the order  was varied on an application by the defendant. This order for an independent forensic  examination held up the determination of the case for well over two years. The order  was however not complied with and on 25th January 2017, I vacated the said order and  ordered the parties to file their respective addresses for judgment to be delivered in  the matter.
