ELFRIEDA OLUWAYEMISI WILLIAMS-DAWODU, JCA (Delivering the Leading Judgement): This appeal emanated from the Judgment of the High Court of the Federal Capital Territory, Abuja delivered on October 16t\ 2008 by Hon. Justice Salisu Garba wherein the entire claim of the Appellant (the Plaintiff at the Court below) was dismissed for failure to prove his "case on the balance of probability." The Counterclaim of the Respondent (the Defendant at the Court below) was equally dismissed.
As gleaned from the printed Record before this Court, the facts involved herein briefly are that, the Appellant was employed by Trans Energy Limited Company which upon its exiting from Nigeria, transferred all the members of its staff to the Respondent. According to the Appellant, the Respondent issued the transferred members of staff with its identity cards, paid every emolument as in the terms of offer of employment by Trans Energy Limited Company.
