OGEBE, J.C.A.: (Delivering the Leading Ruling): In this motion, the applicant seeks the following reliefs:-

1.An order extending the time within which to appeal as of Right under S. 220(l)(a) 2(b) of the 1979 Constitution against the judgment instant out of time which judgment was delivered on the 18/3/87 which was just being tendered in evidence as Exhibit "C" in HCR/20/87 over the same subject matter and the same parties.

2.An order of this Honourable Court allowing appellant to file his Notice of Appeal and Grounds of Appeal out of time in the trial Court for onward transmission to the Court of Appeal.

3.An order of Direction to the trial court by this Honourable Court for a stay of proceedings of HCR/20/87 with all its accompanying motions by reason of the grounds alleged in paragraph 1 supra until the final determination of this action and the appeal.

4.And/or an order of direction to the trial court to strike out the ongoing matter as being incompetent, misconceived, erroneous and i…
