RULING ON MOTION TO DISMISS SUIT 

i. Introduction: 

[1] As per Motion on Notice premised on the Inherent Jurisdiction of the Court and filed in the  registry of the Court on June 6, 2018 by learned Counsel for and on behalf of the  Defendants/Applicants herein, the Applicants seek an order of this court to: 

“…dismiss the suit against the Defendants for the reasons in the supporting affidavit...”  

ii. Background: 

[2] It recalls that on the 10th day of May, 2018 the Plaintiff commenced this instant action by issuing a writ of summons against the Defendants herein for the following judicial reliefs: 

a. A declaration that the pronouncements made by the 2nd Defendant and broadcast by Adom  Fm 106.3 MHz operated by the 1st Defendant on 19th April, 2018 during the Morning Show  as captured in the particulars under paragraphs 13 of the Statement of Claim are false,  defamatory and malicious.
