JUDGEMENT
This is an appeal from the judgment of Circuit Court A, Tema presided over by Her Honour Agnes Opoku-Barnieh, delivered on 28th August, 2023. The Appellant was charged, with the offence of defrauding by false pretences contrary to Section 131 of the Criminal Offences, Act, 1960, Act 29 and arraigned before the trial Court on 24th June, 2021.
The undisputed facts of this appeal are that the Complainant, Theresa Adjei (PW1) aged 72 is an Evangelist resident in Community 2, Tema, whilst the Appellant aged 49 years and lived in Tema New Town. PW1 was a friend of one Benedicta Galley (PW2). In the year 2018, PW1 discussed her intention to buy a house within the Tema Metropolis with PW2, who passed the information on to a house agent by name Kojo Kukubor now deceased. In March, 2019, Kojo Kukubor called PW2 and informed her that the Appellant had a two-bedroom house for sale at J County, a suburb of Community 2, Tema.
