MOHAMMED AMBI-USI DANJUMA, J.C.A. (Delivering the Leading Judgment): This appeal stems from the decision of Hon. Justice W. A. Akintoroye of the High Court of Ondo State, sitting at the Akure Judicial Division delivered on the 29th November, 2012.
By a writ of summons dated 10/2/2004 the plaintiffs, herein the appellants commenced this action against the defendants/respondents claiming the following reliefs.
1. AN ORDER OF DECLARATION that the plaintiffs are entitled to the statutory right of occupancy in respect of the piece or parcel of land appropriately described as Fasanmokun Family Layout situates, being and lying at Oke - Odu; along Akure/Ijare Road in the Akure Local Government of Ondo State of Nigeria.
