ASARE KORANG J.: In this action the plaintiff says it holds a lease from the Government of Ghana over a plot of land in the Cantonments Residential Area of Accra, on which stands house No F269/5, Cantonments Road, Accra. The plaintiff sublet the property to Technoserve Inc which in turn sublet part of the premises to the fourth defendant herein.

On 4 October 1978, the plaintiff approved structural modification to the premises to allow the fourth defendant to have proper restorage of his equipment. Notwithstanding this limited permission, the fourth defendant began to make substantial developments and structural modifications to the property for the purpose of using the premises as a hospital. The plaintiff therefore sued the fourth defendant in the High Court, Ho claiming:

(i). “Recovery of possession of house No F269/5 Cantonments Road, Accra.

(ii). An order setting aside the sublease agreement between the plaintiff and the defendant covering the said house.
