JAURO JCA (Delivering the Lead Judgment): This is an appeal against the judgment of the High Court of Lagos State, coram . Hon. Justice Olusola Williams delivered on 9 January 2008 in Suit No. ID/1239/2001. The facts giving rise to this appeal, briefly stated are as follows: The claimants now appellants instituted the action culminating in this appeal in the High Court of Lagos State with suit No. ID/1239/2001, and in their further and better amended statement of claim dated 12 September 2005 claimed for the following reliefs: i. “A declaration that the claimants/appellants are the owners of and/or are entitled to the statutory right of occupancy of and over all that expanse of land known as Igando land, measuring approximately 2000 Acres, lying, being and situate at Igando Alimosho Local Government Area of Lagos State and more particularly described in the survey plan filed herewith.
