FREDERICK OZIAKPONO OHO, J.C.A. (Delivering the Leading Judgment): This is an appeal by the 1st to 6th Appellants against the judgment of the High Court of Anambra State of Nigeria (hereinafter referred to as: “the Court below”) sitting at Aguata Coram: V. N. AGBATA J, and delivered on 26th day of March, 2014. The Plaintiffs now 1st and 2nd Respondents filed a writ of summons against the Appellants for declaration of title over Udengwara land, injunctive orders and damages for trespass. The Appellants on the receipt of summons filed a statement of defence and counter claim, asked for a declaratory relief, injunction and damages against the 1st and 2nd Respondents. At the middle of the trial, the 1st to 9th Defendants on their own motion joined in the suit and claimed both declaratory, injunctive orders and damages over the same land. They named in this appeal as the 3rd to 5th Respondents.
