JAMES GAMBO ABUNDAGA, JCA (Delivering the Leading Judgment): This is an appeal against the judgment of High Court of Kaduna State sitting at Saminaka in Suit No. KDH/Z/129/2016 delivered on 14/5/2018 by Hon. Justice N.U. Sadiq (PP. 204-222 of the record of appeal).
Not satisfied with the judgment in which judgment was entered in part for the plaintiffs, the defendants filed an appeal to this court vide a notice of appeal which was filed on 5/6/2018. The notice of appeal contains four (4) grounds of appeal inclusive of the omnibus ground of appeal. (See pages 223-227 of the record of appeal).
The record of appeal was compiled and transmitted on 24/1/2019 and deemed properly compiled and transmitted on 27/3/2019. Thereafter parties filed their respective briefs of argument.
The appellants filed their brief of argument on 30/1/2023. It was deemed properly filed and served on 18/1/2024. In reaction to the Respondents’ brief of argument, the Appellants filed their reply brief on 9/2/2024.
