HARUNA SIMON TSAMMANI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Ogun State High Court sitting at Ota, delivered on the 28th day of February, 2014.
By a Writ of Summons dated the 5th day of July, 1993 which was followed by a Statement of Claim dated the 22/3/94, the Appellants as the Claimants sought the following reliefs:
1. A DECLARATION that the Plaintiffs are the persons entitled to the Statutory Right of Occupancy to all that piece or parcel of land lying, situate and being at Iju Mosan Road, Otta Local Government Area, Ogun State, which is more particularly described and delineated on Survey Plan No. SJA/005T/94/OG. Dated the 14th March, 1994 and drawn by Licensed Surveyor S. J, ANTHONY.
2. N500,000 being special and general damages for trespass committed by the Defendants, their servants and/or privies on the said parcel of land described above.
