ADEREMI, J.C.A. (Delivering the Leading Judgment): Sequel to the preliminary objection raised before the Federal High Court holden at Lagos. Odunowo J. presiding made the following orders on the 30th May, 1997:

(1) That Professor Kasunmu shall serve all the court processes in this suit on Mr. Adegbesan who has agreed to accept them in his chambers.

(2) That all the parties to these suits i.e. FHC/L/CP/567/97 and FHC/L/CP/608/97 are hereby restrained from publishing, selling, offering for sale or advertising any magazine or publication under the name or title of "FAME" OR "NATIONAL ENCOMIUM" pending the hearing and determination of the motion on notice in both suits.

(3) That all the parties to both actions shall keep the peace in the mean time.

It would appear that the appellants/respondents have remained in contempt of the said orders made by Odunowo J. on 30/5/97 in that they have since produced the 24th issue of the magazine "National Encomium" since the orders were made and they…
