JUDGMENT
1.0. INTRODUCTION
1.1. The plaintiff as a company limited by guarantee was established for the purpose of assist peasant farmers to improve their lots in farming activities. The defendant was the chief executive officer (CEO) of the plaintiff and at a point in time the plaintiff major financier felt that the defendant has perpetrated fraud on the plaintiff.
1.2. The plaintiff on 13th December 2023 instituted action against the defendant at the Commercial court seeking the reliefs as endorsed on the writ of summons.
2.0. RELIEFS BEING CLAIMED BY THE PLAINTIFF
2.1. The plaintiff reliefs are as follows:
a. Recovery of the amount Three Hundred and Fifty-Two Thousand Euros (352,500).
b. Interest on the amount of Three Hundred and Fifty-Two Thousand Euros (352,500) from September 1, 2023, till date of final payment.
c. An order compelling the defendant to provide the 180 MoUs, each carrying 2 farmers signatures as required by the plaintiff.
