ONNOGHEN, JCA (Delivering the Lead Judgment): This is an appeal against the judgment of the High Court of Ekiti State in suit No. HAD/6/94 delivered by Hon. Justice J. A. Ajakaiye, Chief Judge, on the 3rd day of October, 1996 in which he dismissed the appellants case as lacking in merit.

By a statement of claim to be found at pages 4 to 7 of the record , particularly at page 6 thereof the appellants claimed against the respondents as follows:
