OGUNTADE, J.C.A.: (Delivering the Leading judgment): On 7th October, 1999, the appellant as the Applicant at the Federal High Court, Lagos in suit No. FHC/L/CS/1146/99 prayed for the orders hereunder appearing against respondents:

“1. A declaration that the respondents established under sections 214 and 215 of the Constitution of the Federal Republic of Nigeria 1999 have the statutory responsibility, duty or function under the Police Act, Cap. 359, Laws of the Federation of Nigeria, 1990 and other relevant Laws in force in Nigeria to prevent, detect and investigate any crime(s) and to investigate criminal allegations whether brought to their notice by individuals, person or persons, corporate bodies, institutions or not against any person or persons, corporate bodies, institutions or any Public Officer or Public Officers, including the President of the Federal Republic of Nigeria or any Governor in any State in the Federation.

2. A declaration that no Governor of any State in Nigeria…
