E.O. WILLIAMS-DAWODU, JCA (Delivering the Leading Judgment): This is an appeal against the Judgment of the Federal High Court, Abuja Division, delivered by Hon. Justice Taiwo Taiwo on March 23rd 2020, wherein the Respondents were discharged from the Nine (9) count Charge against them, as the Court found in their favour.
The facts that culminated into the instant appeal briefly as garnered from the printed Record before this Court are that, the Registered Trustees of Indigenous Contractors Association of Kwara State wrote a letter of complaint dated June 13th 2018 to the Bureau of Public Procurement against the Rector of Kwara State Polytechnic, Ilorin, that he awarded four (4) contracts in the years 2014, 2015 and 2016 in respect of TETFUND projects in a manner contrary to the Public Procurement Act.
