IGNATIUS IGWE AGUBE, J.C.A. (Delivering the Leading Judgment): This Appeal is against the judgment of the Federal High Court of Nigeria sitting in Makurdi, in Suit No. FHC/MKD/CS/83/2017, delivered by Honourable Justice M. O. Olajuwon on the 24th day of February, 2020, whereof the learned trial Judge entered judgment in favour of the Respondent by declaring null and void the proceedings and decision/report of the Committee on Examination Misconduct of the College of Engineering dated 27th July, 2016 for being against the principles of fair hearing and also ordered that the Respondent be reinstated to the 1st Appellant’s University on the academic level he was before his expulsion. Meanwhile, the sum of Two Million Naira (N2,000,000.00) was equally awarded to him as damages against the Appellants jointly and severally.
