WILLIAMS-DAWODU, JCA (Delivering the Leading Judgment): The Appellants (who were the Plaintiffs at the Court below) have appealed to this Court against the Ruling of the Federal High Court, Abuja, delivered on May 20th 2014 wherein the Court found as an abuse of its process the Appellants' Suit and dismissed same.

As garnered from the Record before this Court, the battle between the parties have been long drawn. Briefly, the Appellants' story is that the 2nd and 3rd Respondents approached the 4th Respondent to enter into a partnership arrangement as technical partners to resuscitate the 5th and 6th Appellants, which are factories for the production of larger beer and soft drinks. That unknown to the 4th Respondent, the agreements, Memorandum of Understanding and the Technical Team Agreement prepared particularly the Technical Team Agreement by the 3rd Respondent were not what was agreed.
